Welcome to NoBull Spice.

These Terms of Service (“Terms”) are entered into between you and NoBull Foods, LLC, doing business as NoBull Spice (“NoBull,” “we,” “us,” or “our”). These Terms govern your access to and use of nobullspice.com, including its content, features, products, purchases, communications, and related services collectively referred to as the “Services.”

By visiting our website, placing an order, creating an account, submitting content, or otherwise using the Services, you agree to these Terms and the policies incorporated into them, including our Privacy Policy, Return & Refund Policy, and Shipping Policy.

Please read these Terms carefully. If you do not agree to them, do not use the Services.

1. Eligibility

You must be at least 18 years old or the legal age of majority where you live to place an order or enter into a binding agreement with NoBull.

Individuals under the legal age of majority may use the Services only with the permission and involvement of a parent or legal guardian.

By using the Services, you represent that you have the legal capacity and authority to agree to these Terms.

2. Acceptable Use of the Website

You may use the Services only for lawful purposes and in accordance with these Terms.

You agree not to:

  • Violate any applicable federal, state, local, or international law.

  • Provide false, incomplete, misleading, or fraudulent information.

  • Use another person’s identity, account, address, or payment information without authorization.

  • Attempt to interfere with the operation, security, or availability of the Services.

  • Introduce viruses, malicious code, automated attacks, or other harmful technology.

  • Attempt to gain unauthorized access to the website, customer accounts, servers, databases, or connected systems.

  • Use bots, scrapers, crawlers, or other automated methods to copy or extract website content without our written permission.

  • Copy, reproduce, or commercially exploit our website, branding, photographs, product descriptions, graphics, recipes, or other content without authorization.

  • Use the Services to infringe another person’s intellectual-property, privacy, publicity, or other legal rights.

  • Engage in fraudulent chargebacks, refund abuse, promotion abuse, or repeated unsupported claims.

  • Circumvent product limits, promotion restrictions, website security, or account controls.

  • Purchase products for unauthorized repackaging, relabeling, alteration, or resale.

  • Use the Services in a way that could harm NoBull, our customers, or another person.

We may restrict, suspend, or terminate access to the Services when we reasonably believe these Terms have been violated or the Services are being used unlawfully, fraudulently, or abusively.

3. Product Information and Natural Variation

We make reasonable efforts to accurately describe and display our products. However, NoBull products contain agricultural ingredients that naturally vary.

Pepper color, size, shape, texture, aroma, flavor, moisture, flake composition, and heat may vary between individual peppers, harvests, suppliers, production runs, and batches. These natural variations do not necessarily mean that a product is defective.

Product appearance may also differ from photographs because of:

  • Lighting and photography.

  • Screen and device settings.

  • Packaging or label updates.

  • Normal settling or movement during shipping.

  • Natural ingredient variation.

  • Changes made to improve a product or its packaging.

Lifestyle photographs may include serving suggestions, prepared dishes, utensils, garnishes, or other items that are not included with the purchased product.

We may update product packaging, labels, ingredients, specifications, descriptions, or presentation when reasonably necessary. Always review the physical product label before using or consuming a product.

4. Ingredients, Allergies, and Dietary Information

Product descriptions, ingredient information, flavor notes, recipes, and dietary information on our website are provided for general informational purposes.

Always read the ingredient statement, allergen information, warnings, preparation instructions, and other information printed on the physical product packaging before consuming a product.

Ingredient formulations, suppliers, processing facilities, and packaging may change. The current physical product label should be used when evaluating whether a product is appropriate for you.

If you have a food allergy, sensitivity, dietary restriction, medical condition, or concern about a particular ingredient, contact us before purchasing and consult an appropriate healthcare professional when necessary.

Do not consume a product if:

  • The seal is missing, damaged, or appears compromised.

  • The container appears opened or tampered with.

  • The product appears contaminated, spoiled, or materially damaged.

  • You believe it contains an ingredient that is unsafe for you.

  • It has been stored or handled improperly.

NoBull cannot guarantee that every product is appropriate for every allergy, sensitivity, diet, or medical condition.

5. Pepper Heat and Safe Handling

Some NoBull products contain hot or extremely hot peppers.

Scoville Heat Unit ratings and other heat-level descriptions are estimates provided for general comparison. Actual heat may vary due to natural differences in peppers, harvests, batches, ingredient ratios, storage, serving size, and individual heat tolerance.

By purchasing or using a hot-pepper product, you understand that it may cause intense heat, irritation, sweating, coughing, digestive discomfort, or other physical reactions.

Use hot-pepper products responsibly:

  • Begin with a small amount.

  • Avoid contact with your eyes, face, skin, and other sensitive areas.

  • Wash your hands, utensils, and preparation surfaces thoroughly after handling.

  • Consider using gloves when handling extremely hot products.

  • Avoid inhaling pepper dust or flakes.

  • Keep products away from children and pets.

  • Do not consume unreasonable quantities.

  • Do not use our products in unsafe eating challenges, pranks, dares, or non-food applications.

  • Do not give an extremely hot product to another person without clearly informing them of its heat level.

You are responsible for determining whether a product is appropriate for you and for using it safely and reasonably.

Seek appropriate medical assistance if you experience a severe, unusual, or unexpected reaction.

6. No Medical or Health Advice

NoBull sells food products and provides culinary information. We do not provide medical, nutritional, dietary, or healthcare advice.

Statements appearing on our website, packaging, advertisements, recipes, emails, social-media accounts, or other communications are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Do not rely on NoBull content as a substitute for advice from a qualified medical professional.

Consult an appropriate healthcare professional regarding allergies, sensitivities, pregnancy, medication interactions, medical conditions, dietary restrictions, or other health concerns.

7. Prices, Promotions, and Availability

Prices are displayed in U.S. dollars unless otherwise stated.

Product prices, availability, discounts, promotions, bundles, and shipping offers may change without notice. A price change will not ordinarily affect an order that we have already accepted, except when the order resulted from an obvious error.

Taxes, shipping charges, and other applicable fees will be displayed during checkout when available.

Placing an item in your shopping cart does not reserve the product or guarantee its price or availability.

Promotions and discount codes may be subject to additional conditions. Unless otherwise stated:

  • Promotions have no cash value.

  • Discounts cannot be applied to prior purchases.

  • Discounts cannot be combined.

  • Promotions may be limited by customer, household, order, product, or location.

  • Promotions may exclude taxes or shipping charges.

  • Promotional codes may not be copied, sold, transferred, or used fraudulently.

  • NoBull may cancel orders involving fraudulent or abusive promotion use.

We reserve the right to correct errors involving product descriptions, prices, promotions, discounts, taxes, shipping charges, inventory, or availability.

If an order is affected by a material error, we may contact you for instructions or cancel the affected portion and refund the applicable amount.

8. Orders and Order Acceptance

Submitting an order is an offer to purchase the products listed in the order.

An automated order confirmation means that we received your order. It does not necessarily mean that we have accepted it.

We may accept an order by processing or shipping it. We may refuse, limit, hold, or cancel an order for legitimate reasons, including:

  • Product unavailability.

  • A pricing or listing error.

  • Suspected fraud or unauthorized payment.

  • Inaccurate billing or shipping information.

  • Shipping restrictions.

  • Promotion abuse.

  • Unusual quantities or suspected unauthorized resale.

  • A violation of these Terms.

If we cancel an order after collecting payment, we will refund the amount charged for the canceled portion to the original payment method.

We may request additional information or verification before accepting or fulfilling an order.

You are responsible for reviewing your product selections, quantities, email address, billing information, and shipping address before submitting an order.

Contact support@nobullspice.com promptly if you discover an error. We will make a reasonable effort to help, but we cannot guarantee that an order can be changed after processing begins.

9. Payment

You authorize NoBull and its payment-service providers to charge the payment method submitted during checkout for:

  • Products purchased.

  • Shipping and handling.

  • Applicable taxes.

  • Other charges clearly disclosed and authorized during checkout.

Payments may be processed by Shopify, financial institutions, or third-party payment providers. Their services may be governed by separate terms and privacy policies.

NoBull generally does not receive or store your complete payment-card number.

We may delay, hold, or cancel an order when:

  • Payment cannot be authorized.

  • The transaction appears fraudulent.

  • The payment information is inaccurate.

  • The payment provider requests verification.

  • A transaction is disputed before fulfillment.

Contact us at support@nobullspice.com if you believe you were charged incorrectly.

Nothing in these Terms limits lawful payment-dispute or consumer-protection rights.

10. Shipping and Delivery

Shipping and delivery dates are estimates unless we expressly state otherwise.

Delivery may be affected by:

  • Carrier delays.

  • Severe weather.

  • Natural disasters.

  • Holidays.

  • Labor disruptions.

  • Incorrect or incomplete addresses.

  • Remote delivery locations.

  • Government actions.

  • Supply-chain interruptions.

  • Other events outside our reasonable control.

You are responsible for providing a complete, accurate, and deliverable shipping address.

NoBull is not responsible for delays, failed delivery, or additional costs caused by an address entered incorrectly by the customer. If a package is returned because of an incorrect or undeliverable address, additional shipping charges may apply before it is resent.

Risk of loss transfers as provided by applicable law.

If we cannot ship an order within the promised or legally required period, we will provide any notice, cancellation opportunity, consent request, or refund required by applicable law.

Shipping charges are generally nonrefundable after an order has shipped unless the issue resulted from an error by NoBull or applicable law requires otherwise.

11. Returns, Refunds, Replacements, and Cancellations

Purchases are governed by our Return & Refund Policy, which is incorporated into these Terms.

Because NoBull sells food products, we do not accept physical returns or exchanges due to food-safety and quality-control concerns. Food-product purchases are generally final sale.

Do not mail a product back to NoBull unless our customer-service team specifically instructs you to do so.

Reasonable concerns will be reviewed individually. Contact us if:

  • Your order arrived damaged.

  • You received an incorrect product.

  • An item was missing.

  • Your package was lost.

  • You have a reasonable product-quality concern.

  • Another legitimate issue occurred with your order.

We may request:

  • Your order number.

  • A description of the issue.

  • Photographs of the product.

  • Photographs of the label, packaging, shipping box, or damage.

  • Other information reasonably necessary to evaluate the concern.

Depending on the circumstances, NoBull may offer a replacement, refund, partial refund, or store credit.

Submitting a request does not guarantee a particular resolution. We may deny requests that appear fraudulent, abusive, unsupported, or unrelated to a product or fulfillment issue.

Approved refunds will generally be issued to the original payment method.

Contact us as soon as possible if you need to cancel or change an order. We will make a reasonable effort to accommodate the request, but an order cannot be canceled or changed after it has entered processing or shipped.

Nothing in these Terms or our Return & Refund Policy limits rights that cannot legally be waived.

12. Customer Accounts

The Services may allow you to create or use a customer account.

You are responsible for:

  • Providing accurate account information.

  • Protecting your login credentials.

  • Restricting access to your account and devices.

  • Activity conducted through your account.

  • Notifying us promptly of suspected unauthorized access.

You may not create an account using false information or impersonate another person or organization.

We may suspend, restrict, or close an account that appears compromised, fraudulent, abusive, inactive, or in violation of these Terms.

13. Reviews and User Content

You may be able to submit reviews, photographs, recipes, comments, testimonials, suggestions, or other content collectively referred to as “User Content.”

You retain ownership of your User Content. By submitting User Content directly to NoBull for publication, you grant NoBull a nonexclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, adapt, publish, display, distribute, and promote that content in connection with our website, products, advertising, social media, and other business activities.

You represent that:

  • You own the content or have permission to submit it.

  • The content reflects your honest experience or opinion.

  • The content does not violate another person’s rights.

  • You have disclosed any incentive or material relationship connected to the content.

  • The content is not false, deceptive, defamatory, threatening, obscene, harassing, or unlawful.

  • The content does not contain malware, spam, unauthorized advertising, or confidential information belonging to someone else.

We may review, moderate, decline, edit for formatting, or remove User Content, but we are not obligated to do so.

Submitting content does not guarantee that it will be published.

If we ask to repost content you shared on social media, any additional permission you provide will govern that use.

14. Intellectual Property

The Services and their content are owned by or licensed to NoBull and are protected by applicable intellectual-property laws.

Protected materials may include:

  • The NoBull name and logos.

  • Blend and product names.

  • Labels, packaging, and trade dress.

  • Product descriptions and flavor profiles.

  • Photographs and videos.

  • Illustrations, icons, artwork, and graphics.

  • Recipes and written content.

  • Website design and layout.

  • Advertising materials.

  • Slogans and other brand elements.

  • Software and website functionality.

You may view and use the Services for personal, noncommercial purposes.

You may not copy, reproduce, republish, modify, distribute, license, sell, publicly display, create derivative works from, or commercially exploit protected materials without our prior written permission.

No right, title, or ownership interest is transferred to you through your use of the Services or purchase of a product.

Unauthorized use of NoBull’s intellectual property may violate copyright, trademark, trade-dress, unfair-competition, or other laws.

15. Third-Party Services and Privacy

The Services may contain links to or integrations with third-party services, including:

  • Shopify.

  • Payment providers.

  • Shipping carriers.

  • Review platforms.

  • Social-media platforms.

  • Analytics providers.

  • Advertising providers.

  • Other websites and applications.

Third parties operate independently and may have their own terms and privacy policies. NoBull does not control and is not responsible for the content, availability, security, products, or practices of third-party services.

A link or integration does not necessarily mean that NoBull endorses the third party.

Your use of third-party services is subject to the third party’s applicable terms.

Our collection and use of personal information are described in our Privacy Policy, which is incorporated into these Terms.

16. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the website, Services, and website content are provided on an “as is” and “as available” basis.

Except for warranties expressly provided by NoBull or warranties that cannot legally be excluded, NoBull disclaims express and implied warranties, including implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, and uninterrupted or error-free operation.

We do not guarantee that:

  • The website will always be available or uninterrupted.

  • Website content will always be complete, current, or error-free.

  • Every website defect will be corrected immediately.

  • The Services will be free from every harmful component.

  • A product will produce a particular flavor, heat, culinary, dietary, medical, or personal result.

  • Every customer will experience the same heat level, flavor, or reaction.

  • Third-party services will always be available or operate without error.

These disclaimers do not affect warranties or rights that cannot legally be excluded or limited.

17. Limitation of Liability

To the fullest extent permitted by applicable law, NoBull Foods, LLC and its owners, officers, employees, contractors, affiliates, suppliers, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or related to:

  • Your use of or inability to use the Services.

  • Website interruptions or errors.

  • Third-party services.

  • Unauthorized access to information.

  • Reliance on recipes, flavor descriptions, serving suggestions, or estimated Scoville ratings.

  • Improper storage, preparation, handling, or use of a product.

  • Unreasonable consumption or participation in an eating challenge.

  • Use of a product contrary to its label, warnings, or intended culinary purpose.

  • Unauthorized alteration, repackaging, relabeling, or resale of a product.

To the fullest extent permitted by law, NoBull’s total liability arising from a particular order will not exceed the amount paid to NoBull for the product or order giving rise to the claim.

These limitations do not apply to liability that cannot legally be limited or excluded, including liability resulting from fraud, willful misconduct, gross negligence where applicable, or another matter for which limitation is prohibited by law.

Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, these provisions apply only to the maximum extent permitted.

18. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless NoBull Foods, LLC and its owners, officers, employees, contractors, affiliates, licensors, suppliers, and service providers from third-party claims, liabilities, damages, judgments, losses, costs, and reasonable legal fees resulting from:

  • Your unlawful or unauthorized use of the Services.

  • Your material violation of these Terms.

  • User Content submitted by you.

  • Your infringement of another person’s rights.

  • Fraudulent activity conducted through your account.

  • Your unauthorized alteration, repackaging, relabeling, resale, or misuse of a NoBull product.

This obligation does not apply to the extent that a claim was caused by NoBull’s own unlawful conduct or responsibility that cannot legally be transferred to you.

19. Changes to the Services and These Terms

We may update the Services, products, website features, policies, or these Terms periodically.

Updated Terms will be posted on this page with a revised “Last updated” date. Material changes will apply prospectively unless applicable law provides otherwise.

Your continued use of the Services after updated Terms become effective means that you agree to the revised Terms.

Terms in effect when an order is placed will generally govern that order.

We may modify, suspend, restrict, or discontinue a website feature or portion of the Services when reasonably necessary. We are not responsible for interruptions caused by maintenance, technical problems, security concerns, or events outside our reasonable control.

20. Governing Law and Dispute Resolution

These Terms and disputes arising from the Services or products are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

This choice of law does not deprive you of mandatory consumer protections that apply under the laws of your state of residence.

Before filing a legal claim, you and NoBull agree to make a reasonable, good-faith effort to resolve the dispute informally.

Include your name, contact information, relevant order number, description of the dispute, requested resolution, and supporting information.

Nothing in this section prevents either party from:

  • Filing an eligible claim in small-claims court.

  • Seeking urgent injunctive or equitable relief.

  • Reporting a concern to a government agency.

  • Taking action necessary to preserve a legal filing deadline.

Unless applicable consumer law requires otherwise, court proceedings arising from these Terms or the Services must be brought in a state or federal court with jurisdiction over Hays County, Texas.

You and NoBull consent to the jurisdiction of those courts.

These Terms do not require binding arbitration and do not prevent a customer from exercising rights that cannot legally be waived.

21. General Terms

If any provision of these Terms is found invalid or unenforceable, it will be modified or enforced to the maximum extent legally permitted. The remaining provisions will continue in effect.

NoBull’s failure to enforce a provision does not waive the right to enforce it later.

You may not assign your rights or obligations under these Terms without our written consent. NoBull may transfer these Terms as part of a merger, acquisition, financing, restructuring, sale of assets, or transfer to an affiliated business.

These Terms, together with the policies incorporated into them, constitute the entire agreement between you and NoBull concerning the Services.

If a product, promotion, wholesale arrangement, or other transaction is subject to specific written terms, those specific terms will control if they conflict with these general Terms.
